Terms of Service — Metropolygonia Free Beta

These Terms govern access to and use of the Metropolygonia website, application, accounts, cloud projects and Free Beta exports. The separate Free Non-Commercial Asset License governs each model exported under the Free Beta plan.

1. Provider and service

The service provider is KUNZ STANISLAW, trading as Metropolygonia, P.IVA 02894360995, registered at Via Camillo Benso Conte di Cavour 42/1, Bogliasco (GE), Italy. Contact: kunzdesign2017@gmail.com.

Metropolygonia is a browser-based tool for procedural and parametric creation of 3D buildings and urban layouts. Geometry is produced from explicit rules, user-controlled parameters and repeatable seeds, not from generative artificial intelligence.

The Free Beta is provided at EUR 0 and does not require a payment card. Commercial plans and commercial asset licences are not currently available.

2. Acceptance and contract formation

You may inspect public pages and use generation and editing functions that are available without an account. By using the website or application, you agree to the rules in these Terms that apply to website and application use.

Creating an account, using cloud-save functions or starting a Free Beta export requires explicit acceptance of the current Terms and the current Free Non-Commercial Asset License. The application records the document type, version, acceptance time, language and source of acceptance.

The Privacy Policy is an information notice, not a marketing consent. Optional marketing and analytics choices are requested separately and are not required to use the generator, create an account or export within the Free Beta allowance.

3. Eligibility and age

The account, cloud-save and export functions are intended only for people aged 16 or older. Do not create an account or export an asset if you are under 16.

You must provide accurate sign-in information and keep your credentials and devices secure. You are responsible for activity performed through your account and should promptly report suspected unauthorised access.

4. Free Beta export allowance

Each eligible account receives:

Unused monthly exports do not roll over. The application displays the applicable allowance period and reset date.

Only a successfully completed new export consumes the allowance. A failed export or released reservation does not consume it. Downloading an already-created file again does not consume a new export. Creating a new export of the same project does consume an export.

After the allowance is exhausted, generation and editing remain available; only creation of a new export is blocked until a new allowance becomes available.

You must not evade technical limits or create multiple accounts to obtain extra exports. The server-side allowance record controls unless the provider corrects a documented error.

5. Projects, local data and cloud data

You are responsible for project parameters, files and materials that you supply to the application and for keeping independent copies of important work.

Some project state may be kept in browser storage. Signed-in users may use identified cloud-save functions where offered. Clearing browser data may remove unsaved local drafts or preferences. Account deletion and data-export options are described in the Privacy Policy and in the application.

Exported model and texture files are prepared in the browser and are not automatically stored by Metropolygonia in the cloud unless a feature expressly states otherwise.

6. Nature of generated outputs

Generated outputs are creative 3D assets. They are not building plans, structural calculations, BIM deliverables, construction documentation, code-compliance checks, engineering advice or architectural advice. Any real-world construction or safety use requires review by appropriately qualified professionals and compliance with applicable law.

Outputs may require downstream work, including material finishing, topology review, collision, lighting, LODs, Nanite configuration, navmeshes, optimisation and validation in the target application.

Procedural outputs are not guaranteed to be unique. Other users may create identical or similar geometry by using the same or similar rules, parameters, styles and seeds.

7. Asset licence

Each Free Beta export is governed by the Metropolygonia Free Non-Commercial Asset License version recorded with that export. These Terms do not grant commercial rights.

The licence applies only to rights that the licensor owns or controls in the exported asset and embedded resources. Third-party notices included with an export or made available in the documentation continue to apply.

8. User-supplied materials

You retain the rights you hold in textures, logos, names and other materials you upload or select from your own files. You grant the provider only the limited permission necessary to process those materials in the application at your request.

You must have all rights and legal bases required to use and process user-supplied materials. You must not submit unlawful, infringing, malicious or sensitive content that the service is not designed to process.

9. Provider rights

The application, generator, source code, algorithms, interface, brand, public website, documentation and built-in resources remain owned by the provider or their respective licensors. Except for the express rights granted by the Free Non-Commercial Asset License, no right to copy, reproduce, distribute, sublicense or commercially exploit those elements is granted.

10. Acceptable use

You must not:

Reasonable normal browser use, accessibility technology and documented integrations are not prohibited.

11. Suspension and termination

The provider may proportionately restrict or suspend an account where there is a material breach, attempted limit evasion, unlawful use, a security threat, abuse of infrastructure or excessive automated load. Where reasonably possible and lawful, the provider will communicate the reason and provide an opportunity to respond.

You may stop using the service at any time and may start account deletion through the application. Refusing a materially updated legal document may prevent a new export, but it will not prevent sign-in, access to existing cloud projects where technically available, project editing, download of available account data or account deletion.

The provider may discontinue the Free Beta or a feature. Where reasonably possible, advance notice will be given for a material discontinuation affecting signed-in users, together with an opportunity to retrieve available project data.

12. Updates and changes to the service

The application may receive security, compatibility, performance and feature updates. Beta functions may change, be withdrawn or become temporarily unavailable.

Where mandatory consumer law governing digital services applies, updates, modifications, conformity requirements and statutory remedies remain available as required by that law. Nothing in these Terms reduces those mandatory rights.

A material change to these Terms or the Asset License receives a new version number, publication date and effective date. Signed-in users will be informed in-app or by email where appropriate. Fresh acceptance may be required before a new export.

13. Availability, compatibility and backups

The provider aims to operate the Free Beta with reasonable care but does not promise uninterrupted availability, error-free output, permanent preservation of every project or compatibility with every current or future version of Unreal Engine, Blender, another DCC tool or other software.

You should keep independent project and export backups. No online service can eliminate every security or availability risk.

14. Consumer rights and remedies

If you use the service as a consumer, all rights that cannot be waived under applicable Italian or European Union consumer law remain in force, including any mandatory rights concerning the supply and conformity of digital content or digital services.

To report a service problem or request a remedy, contact kunzdesign2017@gmail.com and provide sufficient information to identify the account and issue. This section does not limit a consumer's right to contact a competent authority or court.

15. Liability

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.

For users acting for business or professional purposes, and to the maximum extent permitted by law, the provider is not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss caused by failure to maintain an independent backup.

For consumers, liability is governed by mandatory law. The provider remains responsible for foreseeable loss caused by a breach where the law requires it, but is not responsible for loss caused by unlawful use, unsupported workflows, user-supplied materials or failure to perform required downstream validation.

16. Privacy, cookies and communications

Personal-data processing is described in the Privacy Policy. Cookies and browser storage are described in the Cookie and Browser Storage Policy.

System and security messages are not marketing. Marketing by email or in-app promotional messages is sent only in accordance with the user's separate channel choice and can be withdrawn without losing core product functions.

17. Governing law and disputes

These Terms are governed by Italian law.

If you are a consumer, this choice does not deprive you of mandatory protections of the law of your country of habitual residence, and any dispute may be brought before the court that has jurisdiction under mandatory consumer rules.

If you use the service exclusively for business or professional purposes, the courts of Genoa, Italy have exclusive jurisdiction, unless mandatory law provides otherwise.

The English and Polish versions are intended to express the same rules. The English version is the administrative reference version, without limiting mandatory interpretation rights or consumer protections.
