Metropolygonia Free Non-Commercial Asset License
This licence is the contract governing a model or city asset package created by a specific export under the Metropolygonia Free Beta plan. The licence version recorded with that export governs that exported asset.
1. Licensor and acceptance
The licensor is KUNZ STANISLAW, trading as Metropolygonia, P.IVA 02894360995, registered at Via Camillo Benso Conte di Cavour 42/1, Bogliasco (GE), Italy.
By starting a Free Beta export after being shown this licence, you accept it for that export. The export record identifies the licence type as free_non_commercial and records the applicable version.
2. Exported Asset
“Exported Asset” means the model, geometry, generated files, manifest and included Metropolygonia-controlled resources produced by one completed Free Beta export.
The term does not include the Metropolygonia application, generator, algorithms, source code, interface, brand, full built-in resource library or any user material that you supplied independently.
Third-party resources remain subject to their own notices and licences. This licence grants rights only to the extent that the licensor owns or controls the relevant rights.
3. Licence grant
Subject to continuous compliance with this licence, the licensor grants you a worldwide, royalty-free, non-exclusive, non-commercial licence to:
- use the Exported Asset in permitted non-commercial projects;
- modify, adapt, combine and render the Exported Asset for those projects;
- make reasonable internal copies needed for those projects; and
- allow your team members or contractors to access the Exported Asset solely to work on the same permitted project on your behalf.
The licence is personal to you and does not permit independent reuse, sublicensing or distribution by a team member or contractor. It remains in force for the Exported Asset while you comply with its terms.
4. Permitted uses
Permitted uses include:
- learning, testing and evaluating Metropolygonia;
- private, non-public projects;
- internal non-commercial prototypes;
- student and educational projects;
- a personal portfolio, including use when seeking employment or freelance work, provided the asset is not delivered as paid client work; and
- public non-commercial games, applications, visualisations, films, images, videos, virtual environments and interactive demonstrations.
You may publish rendered images and videos of a permitted project. You may distribute a compiled or interactive non-commercial project when the Exported Asset is integrated into that project and is not intentionally offered as a separately downloadable raw asset.
5. Attribution
Every public non-commercial project using the Exported Asset must display the following attribution in a reasonably visible location appropriate to the project:
Created with Metropolygonia
Suitable locations include credits, an about page, a README file, a project description or an equivalent credits screen.
The attribution does not imply endorsement by the licensor and does not grant any trademark right beyond displaying the required credit.
6. Commercial use is not licensed
You must not use the Exported Asset in or for:
- a paid game, application, film, visualisation or digital product;
- a paid client commission or deliverable;
- an advertisement, sponsored campaign or commercial promotional asset;
- a subscription, paid access product, paid download or product sold with the Exported Asset included;
- an ad-supported, donation-gated or otherwise revenue-generating release; or
- any business use in which the Exported Asset contributes directly to revenue, a paid service or a commercial client deliverable.
“Internal prototype” means an evaluation used inside an organisation. It does not permit publication, delivery to a paying client or incorporation into a revenue-generating release.
A personal portfolio remains permitted under section 4 even when it is used to present your skills, provided the Exported Asset itself is not sold, licensed or delivered as paid client work.
7. No sale or raw redistribution
You must not:
- sell, rent, sublicense or separately monetise the Exported Asset;
- publish it on a marketplace, stock library, model repository or asset-sharing platform;
- distribute or make available the raw model, raw texture files, package or manifest as a reusable download;
- create an asset pack, template library or competing resource library from it; or
- enable users of a published project to extract or download the Exported Asset as a standalone reusable asset.
Normal technical extraction risks inherent in distributing a compiled project do not by themselves breach this section if you did not intentionally provide the asset as a reusable download and used reasonable project-appropriate protection.
8. Modifications and derivative work
You may modify the Exported Asset for a permitted project. Modifications do not convert the licence into a commercial licence and do not remove the attribution requirement for public projects.
You retain any rights that may arise in your original additions, subject to the licensor's and third parties' pre-existing rights. This licence does not transfer ownership of the underlying Metropolygonia technology or controlled resources.
9. User-supplied materials
You retain the rights you hold in textures, logos, names and other materials you supplied. You are responsible for having all rights and legal bases needed to use them.
The licensor does not acquire ownership of user-supplied materials and does not guarantee that combining them with an Exported Asset is lawful.
10. Third-party resources
An export may contain or refer to resources governed by a third-party licence. Any third-party notice supplied with the export or identified in the application or documentation applies in addition to this licence.
This licence does not grant a broader right in a third-party resource than the third-party licensor allows. Where a third-party licence requires attribution, notice preservation or another condition, you must comply with it.
11. No exclusivity or guaranteed uniqueness
The licence is non-exclusive. Because Metropolygonia is procedural, other users may generate identical or similar buildings, layouts, materials or configurations. You receive no exclusive right in a shape, seed, rule, style or configuration produced by shared generator logic.
12. Future commercial plans
A Free Beta export does not automatically receive commercial rights if a paid or commercial plan becomes available later. A future commercial licence may require a new export made while the relevant plan is active and acceptance of the licence then in force.
Nothing in this section promises that a commercial plan will be launched by a particular date or on particular terms.
13. Breach and termination
Rights under this licence end for any use that materially breaches its terms. You must stop the prohibited use and stop distributing the affected project or asset where reasonably possible.
Termination does not remove accrued legal remedies. Sections concerning ownership, attribution already due, user materials, third-party resources, prohibited redistribution, liability and governing law survive to the extent necessary to protect the parties' rights.
14. Warranty and liability
The Exported Asset is generated in a beta tool and may contain errors or require downstream review. It is not supplied as construction documentation, engineering output or a production-ready game asset.
Nothing in this licence excludes fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, mandatory consumer rights, or any liability that cannot legally be excluded or limited.
To the maximum extent permitted by law for non-consumer use, the licensor is not liable for indirect or consequential loss, loss of profit, loss of business or loss caused by unsupported workflows or failure to validate the asset in its intended environment.
15. Governing law and contact
This licence is governed by Italian law. Mandatory consumer protections and mandatory jurisdiction rules remain unaffected.
For business or professional users, the courts of Genoa, Italy have exclusive jurisdiction unless mandatory law provides otherwise.
